#nascar ... john Middlebrook has heard 4 appeals AND REDUCED penalties in each case with this verdict

From Dustin Long on Twitter, looks like Knaus/Hendrick got off easy, IMO

Right decision IMO. I knew this would get overturned. The whole thing was ridiculous from the start.

I think penalizing the #48 team in the first place made NASCAR look a lot worse, I'm so glad the penalties were rescinded

John Middlebrook resigns as NASCAR's chief appellate officer saying he wants to spend more time with his family.


Can't imagine John Darby and Helton are very happy. Heads will roll over this one.

The only problem I see with this is how they screwed Bowyer in the chase a few years back.

The only difference was, Bowyer's penalty was after the race. Good call NASCAR, for once.

So, by the precedent set here, pre-qualifying inspection is a gigantic waste of time and resources.

If this were anybody else (Besides Junior and Gordon because then their bandwagon fans would go ape *BLEEP* crazy on NASCAR) had these penalties, they would NEVER of overturned them. I remember something like this happened to Mark Martin when he tried to win the 2002 Championship. Tony Stewart punches a camera man and gets away scott-free, but Mark Martin has one bad spring that wouldn't have made a difference in performance, gets docked 50 or 100 points, (I can't remember the exact amount.) Once they hand out the penalty, then it should be final. No overturns or changes should be made.

Look at it this way. You're getting ready to take a math test in school. The teacher comes up and says "I'm taking half your grade out because you cheated". That's not fair at all and it's what happened to this #48 team. From what I understand the claw never even came down on the car, so basically some Nascar inspector eye-balled those c-pillars and said "Nope no good.".

The deal with Bowyer and Martin that have been mentioned. Those were post-race penalties meaning it was after a points race. So those are different.

I think my problem with the ruling is that they gave him such a severe penalty then just basically got rid of them. This occurance wasn't all that bad, IMO, seeing as how the car never hit track, I just don't think it looks very good when you come down on someone with such a stiff penalty only to have someone come along and say, "nope we didn't mean any of that carry on"

Well apparently if Johnson were to take the test, he would go into the room having some of the answers written on his shoe.

I imagine if Knaus & Malec had been acquitted as the crew/car chief of the #88 team, many of the opinions in this thread would be much more positive. Poor guys won't get the respect they deserve for another 30 years.

I don't get what the big fuss is about. NASCAR righted a wrong (for once) and people are still complaining. Who cares if it makes NASCAR "look bad." You live and learn, and try to do better the next time, just like in life.

My applauds to NASCAR for fixing their mistake.

I believe that they reversed the rest of it and upheld this portion of the punishment is because they have been penalized before and they were not totally innocent, so the money stayed the same as it goes to the FUND which is for charity that NASCAR contributes to during the season.
I;m totally satisfied with the final decision.

I guess after 5 championships, it's safe to say that $100,000 is chump change to them now.
